Web shop terms and conditions

These terms and conditions apply to every order placed via www.aveleon.eu, a web shop of BBerg, Lange Beijerd 5, 5431 NR Cuijk, KvK 17246975.

1. Applicability

These terms and conditions and mandatory Dutch consumer law apply to consumer purchases made through this web shop. Where any provision would conflict with a statutory right of the consumer, the statutory right prevails.

2. Products

Our decorative cushions are made from original Sunbrella® leftover fabric. Because we work with leftover batches, every fabric is available in limited quantities and a colour may differ slightly from the photo on your screen. The size is 45x45 cm unless stated otherwise.

3. Prices and payment

All prices are in euros and include VAT, excluding shipping costs. You can pay with iDEAL, credit card (Visa, Mastercard, American Express, Maestro up to € 2,500), PayPal or Bancontact. We cover the transaction costs.

4. Delivery and shipping

Shipping is handled by PostNL; you will receive a Track & Trace code by email. Shipping costs: Netherlands € 4.95; Belgium, Germany and France € 9.95. Shipping is free from €120 in the Netherlands and from €150 in Belgium, Germany and France. We deliver from stock and as a rule dispatch within 1-2 working days; the final delivery deadline is 30 days after your order. If we cannot meet this, you may cancel the purchase free of charge and get your money back.

5. Right of withdrawal and returns

As a consumer, you may withdraw from the purchase within 14 days of receipt without giving a reason. After notifying us, you have a further 14 days to return the product. Notify us at info@aveleon.eu. See our return and refund policy for full details.

The statutory right of withdrawal applies to consumers, not purchases made for business or professional purposes (B2B). An order for a project is not automatically a business purchase and does not exclude a consumer’s right of withdrawal. Our standard cushions are covered by the withdrawal period described above.

6. Conformity and warranty

You are entitled to a product that conforms to the agreement. If a cushion is damaged, incorrectly delivered or develops a defect within its expected lifespan, please email info@aveleon.eu. We will repair, replace or refund. These statutory rights are not limited by these terms and conditions.

In addition, we give a 5-year warranty on the cover of our cushions, counted from the date of delivery. If a seam or zip fails under normal use, please email info@aveleon.eu with your order number and a photo. We will fix it free of charge by repair or replacement. This warranty is in addition to your statutory rights and does not limit them.

7. Complaints

Email complaints to info@aveleon.eu. We provide a substantive response within 14 days. If we cannot resolve the matter together, you may refer the dispute to the competent court.

8. Governing law

All agreements are governed by Dutch law.
